If your ex spouse served you with a Notice of Family Claim for an uncontested divorce, however, has failed to complete and file the remaining documents, you can move the process forward by following these steps:
1. File a Response and a Counterclaim - Complete and file a Response to Family Claim (Form F4) and a Counterclaim (Form F5).
- In the counterclaim, you will be the claimant. Tick the box that says that you are asking for “An order for divorce”. You will also need to complete Schedule 1.
- Note on Fees: There is typically a $25 fee to file a Response and a $200 fee to file a Counterclaim.
2. Serve the Documents - You must serve the filed Response and Counterclaim on your spouse. While they originally served you personally, you can serve these documents by "ordinary service". You can mail the documents to the other party, or if they provided an email address for service on their original Notice of Family Claim, you can serve them by email. 3. Wait 30 Days - Your ex spouse has 30 days to respond to your Counterclaim. If they do not respond within that time, your Counterclaim becomes "undefended” or "uncontested" and you can then proceed with the next steps.
4. File for a "Desk Order" Divorce - Once the 30-day waiting period has passed, you can file the remaining documents. See the guide Sole Application for Uncontested Divorce for the remaining steps.
